1. What CrappyCar Witch Is — and Is Not

1.1 The Service Is an Educational and Informational Tool

CrappyCar Witch provides cost modeling, data synthesis, and AI-generated analysis to help you think through a vehicle keep-or-replace decision. It is not a substitute for professional advice.

Specifically:

• The Service is not a financial advisor. Nothing in the Service — including the Witch's Verdict, the Counsel narratives, the Steelman counterargument, the Prophecy Matrix, the Break-Even Threshold, or any other output — constitutes financial advice, investment advice, or a recommendation to buy, sell, or hold any financial product. The Service does not create a financial advisory relationship between you and CrappyCar Witch.
• The Service is not a mechanic. Nothing in the Service constitutes mechanical advice, a repair recommendation, or a professional assessment of your vehicle's condition. The Service cannot inspect a physical vehicle. Reliability data reflects the statistical record of your vehicle's make, model, and year — it does not reflect the actual condition of your specific car.
• The Witch's outputs are estimates. All cost projections carry an inherent uncertainty of approximately ±20%, which is rendered visually in the Service. Inputs sourced from third-party public data (NHTSA, EPA, EIA) may be incomplete, inaccurate, or out of date. The accuracy of any analysis depends entirely on the accuracy of the information you provide.
• AI-generated content may contain errors. The Witch's Verdict, Counsel narratives, and Steelman counterarguments are generated by a third-party large language model (LLM). AI-generated content may contain factual errors, omissions, or statements that are inconsistent with your input data. The Counsel narratives and Steelman are analytical frameworks constructed from your inputs; they are not diagnostic conclusions and do not represent the independent judgment of a qualified professional. No AI-generated output in the Service has been reviewed by a human professional before delivery to you.

1.2 Consult Professionals

Before making a major vehicle purchase or repair decision, we recommend:

• A qualified mechanic inspection (particularly before committing to a replacement vehicle purchase)
• A financial advisor, if the decision has significant implications for your household finances

1.3 Your Responsibility for Inputs

The quality of any analysis is determined by the accuracy of what you enter. You are responsible for providing accurate information. Analyses based on inaccurate inputs produce inaccurate outputs. CrappyCar Witch has no way to verify the information you submit.

2. Accounts

2.1 Eligibility

You must be at least 18 years old to create an account or use the Service. By creating an account, you represent that you meet this requirement.

2.2 Account Security

Access to your account is secured by a one-time passcode sent to your email address. You are responsible for maintaining access to your email account and for any activity that occurs under your CrappyCar Witch account. Notify us immediately at privacy@crappycar.io if you become aware of unauthorized access.

2.3 One Account Per Person

Accounts are personal and non-transferable. Creating multiple accounts to circumvent usage limits or access restrictions is a violation of these Terms.

2.4 Account Deletion

You may delete your account and all associated data at any time via Account Settings > Account Deletion. Deletion is immediate and permanent. See our Privacy Policy for details on what data is removed.

3. Shareable Reading Links

3.1 What Sharing Does

When you share your analysis using the Share feature, a publicly accessible link is created at crappycar.io/reading/{slug}. Anyone with this link can view your reading — no account required.

By creating a shared reading, you grant CrappyCar Witch a non-exclusive, royalty-free license to host and display that content for the duration of the share link.

3.2 Expiry

Shared reading links expire automatically 30 days after creation.

3.3 Your Responsibility for Shared Content

When you share a reading, you are making your vehicle analysis results accessible to anyone with the link. Review what is included before sharing. CrappyCar Witch is not responsible for any consequences arising from your choice to share your analysis.

3.4 User-Generated Content

The analysis inputs you enter — including repair descriptions and mechanic quotes — are your content. If you share a reading that contains content that is false, defamatory, offensive, or otherwise harmful, you are solely responsible for it. CrappyCar Witch is not liable for any claims arising from content you choose to share.

3.5 Shared Content Is Not Endorsement

Shared readings reflect your specific vehicle situation and inputs. The Witch's verdict for your specific car is not a general statement about any vehicle, make, model, or year, and should not be represented as such.

4. Acceptable Use

You agree not to:

• Scrape or crawl the Service in any automated manner, or access the Service via bots, scripts, or other automated means, without our prior written permission
• Reverse engineer the Curse Score methodology, the credibility-blend model, or any other proprietary analytical component of the Service
• Misuse AI outputs — for example, by deliberately entering false information to generate a misleading analysis and then sharing or publishing it as genuine
• Use the Service commercially to provide consulting, resell analyses, or create derivative products without our prior written permission
• Attempt to circumvent authentication, rate limits, or any other security or access control
• Use Service outputs to train AI systems — you may not use outputs generated by the Service, including the Witch's Verdict, Counsel narratives, Steelman counterarguments, or Prophecy Matrix data, to train, fine-tune, benchmark, or evaluate any machine learning or artificial intelligence model, without our prior written permission
• Use the Service in any manner that violates applicable law or these Terms

We reserve the right to terminate accounts that violate these prohibitions without notice.

5. Feedback

If you submit suggestions, ideas, or other feedback about the Service ("Feedback"), you assign to CrappyCar Witch all right, title, and interest in that Feedback, including any intellectual property rights. CrappyCar Witch may use Feedback for any purpose without compensation or attribution to you. You represent that any Feedback you submit is your own and does not infringe any third-party rights.

6. Intellectual Property

6.1 Our IP

The Service, including the Curse Score methodology, the credibility-blend algorithm, the brand identity, visual design, all written content, and all software, is owned by CrappyCar Witch and protected by applicable intellectual property law. These Terms do not transfer any ownership of our intellectual property to you.

6.2 Your Analysis Results

The analysis results generated for your account are yours to use for personal, non-commercial decision-making purposes. We grant you a personal, non-exclusive, non-transferable license to use, save, and share your analysis results.

6.3 AI-Generated Output

The Witch's Verdict, Counsel narratives, and Steelman content are generated by a large language model. The copyright status of AI-generated content under U.S. law is currently unsettled. We claim no copyright in AI-generated output that is uniquely tailored to your inputs, but we do assert rights in the platform, prompts, formatting, and analytical framework that produced it.

7. Third-Party Data and Services

The Service incorporates data from NHTSA, EPA, EIA, and other public sources. This data is provided by third parties over whom we have no control. We make no representation regarding the accuracy, completeness, or timeliness of third-party data.

Links to third-party sites (e.g., nhtsa.gov for recall verification) are provided for your convenience. We are not responsible for the content or practices of third-party sites.

The AI analysis features of the Service use a third-party large language model API. Your use of those features is subject to that provider's acceptable use policies.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CRAPPYCAR WITCH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS
• ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ANALYSIS, ESTIMATE, OR AI-GENERATED CONTENT
• ANY WARRANTY AS TO THE ACCURACY OR COMPLETENESS OF THIRD-PARTY DATA (NHTSA, EPA, EIA, OR OTHER SOURCES)

The Service does not warrant that any vehicle analysis is accurate for your specific vehicle, that any cost projection will reflect your actual future costs, or that following the Witch's verdict will result in any particular financial outcome.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

CRAPPYCAR WITCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• FINANCIAL LOSSES ARISING FROM VEHICLE PURCHASE OR REPAIR DECISIONS MADE IN RELIANCE ON THE SERVICE
• VEHICLE DAMAGE, MECHANICAL FAILURE, OR PERSONAL INJURY ARISING FROM VEHICLE USE
• LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES

IN NO EVENT WILL CRAPPYCAR WITCH'S TOTAL LIABILITY TO YOU EXCEED $50.00 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. If you are located in such a jurisdiction, some of the above limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless CrappyCar Witch and its officers, directors, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party right
• Any false or inaccurate information you provide to the Service

11. Termination

11.1 Your Right to Terminate

You may stop using the Service at any time. You may delete your account via Account Settings.

11.2 Our Right to Terminate

We may suspend or terminate your access to the Service, with or without notice, if:

• You violate these Terms
• We determine in good faith that your use is harmful to the Service or other users
• We discontinue the Service

11.3 Modification of Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes changes to features, functionality, and the analytical methodologies used. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

11.4 Effect of Termination

Upon termination, your right to use the Service ends immediately. Sections 1, 8, 9, 10, 12, and 13 of these Terms survive termination.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law provisions.

12.2 Informal Resolution First

Before initiating any legal proceeding, you agree to contact us at privacy@crappycar.io and attempt to resolve the dispute informally. We will attempt to respond and resolve the issue within 30 days. This is a condition precedent to filing any legal claim against us.

12.3 Jurisdiction

Any legal proceeding that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts. You consent to the personal jurisdiction of those courts.

12.4 Small Claims

Either party may bring an individual claim in small claims court in lieu of the procedures above, provided the claim qualifies for small claims court in the applicable jurisdiction.

12.5 Class Action Waiver

YOU AND CRAPPYCAR WITCH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The small claims carve-out in Section 12.4 is an exception to this clause.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before the updated Terms take effect. The "Last Updated" date at the top of this page reflects the most recent revision.

Continued use of the Service after the effective date of a material change constitutes your acceptance of the updated Terms. If you do not agree to a change, your remedy is to stop using the Service and delete your account.

14. Miscellaneous

Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and CrappyCar Witch regarding the Service and supersede all prior agreements or understandings.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect. An unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.

No assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
